Overview
Binder respects intellectual property rights and expects users to do the same. This policy explains how to report content that infringes copyright and how we respond.
1. Reporting copyright infringement
If you believe Content on the Platform infringes your copyright, send a notice to our designated agent at the email below including:
• identification of the copyrighted work you say has been infringed;
• identification of the infringing Content and where it is on the Platform;
• your name, address, email and telephone number;
• a statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law;
• a statement that the information is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner; and
• your physical or electronic signature.
2. What we do with a valid notice
We will act expeditiously to remove or disable access to Content that is the subject of a valid notice, and we will take reasonable steps to notify the user who posted it.
3. Counter-notice
If your Content was removed and you believe this was a mistake or misidentification, you may send a counter-notice with: identification of the removed Content and its previous location; your contact details; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your signature. We may restore the Content unless the complainant brings legal proceedings.
4. Repeat infringers
We will, in appropriate circumstances, restrict or terminate the accounts of users who repeatedly infringe copyright.
5. UK position and our role as a host
Binder operates from the UK. As a host of user content, we are generally not liable for infringing Content we do not know about, provided we act expeditiously to remove it once notified. This policy gives effect to that by providing a clear notice route.
6. Misuse of this process
Submitting a false notice or counter-notice may give rise to liability. Please only use this process in good faith.
