Children’s Access Assessment

Overview
This is Binder’s children’s access assessment under sections 36–37 of the Online Safety Act. It determines whether the duties to protect children apply to the Platform.
1. The test
We must assess: (a) whether it is possible for children to access the Platform or any part of it; and (b) if so, whether a significant number of children use it, or it is likely to attract a significant number of child users. A service is treated as one children cannot access only where age assurance is used that is highly effective at correctly determining whether a user is a child.
2. Binder’s position
Binder is designed and intended for adults aged 18 and over only.
We operate age assurance (via Stripe) intended to be highly effective at preventing under-18s from accessing the Platform (see the Age Assurance Policy).
On that basis, our assessment is that it is not possible for children to access the Platform, and the children’s risk assessment and child-safety duties do not apply.
3. Conclusion (conditional)
Our conclusion that children cannot access the Platform holds only ifthe age assurance in place meets Ofcom’s ‘highly effective’ standard (technically accurate, robust, reliable and fair). If it does not, children may be able to access the Platform, and we must instead carry out a children’s risk assessment and comply with the child-safety duties.
4. Record-keeping and review
We record this assessment and will review it if the age assurance changes, before significant new features, and at least annually.
